Supergiant and Supergiant.io are branded products of Qbox, Inc, a Delaware Corporation with location at 320 N Rollston, Ste 102, Fayetteville, AR  72701. This Privacy Policy applies to information collected via the website Supergiant.io website (“Site) and the services operated by the company (“Services”), Qbox, Inc. (“Qbox”). Supergiant offers “container orchestration” services for our customers. The terms “You,” “Your,” or “Customer” applies to users of the Site and Services.

What Data Do We Collect?

Potentially Personal Data.

We collect IP addresses for visitors, and we also collect a list of approved IP addresses from Customers to limit access to Customer Data and keep it secure.

Personal Data

“Personal Data” means any information relating to an identified or identifiable natural person.   If you are interested in receiving more information about our Services or signing up to purchase our Services on the Site or to contact us about support for the Services, we will collect your name, email address, and phone number as well as your IP Address and location.

If you become a paying Customer, we will collect your name, entity authorizing you to bind them to become a paying customer, address, email address, phone number, and user/password (“Contact Information”) as well as payment information such as a credit card number for us to transmit to our payment processor. We do not store credit card numbers or bank information.

Tracking Data

We collect Tracking Data regarding use of our Site and Services and the Site pages visited.

Log Files. As is true of most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, internet service provider, referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, administer the Site, track users’ movements around the Site, gather demographic information about our user base as a whole, and better tailor our Site and Services to our users’ needs. Except as noted in this Privacy Policy, we do not share Tracking Data with third parties.

Cookies

When you visit our Site we use cookies, or similar technologies like single-pixel gifs and web beacons, to record log data. We use both session-based and persistent cookies. Session-based cookies last only while your browser is open and are automatically deleted when you close your browser. Persistent cookies last until you or your browser delete them or until they expire. They are unique and allow us to do site analytics and customization, among other similar things. Google Analytics  Google Analytics collects information about the use of the Services on our website. Google Analytics collects information such as how often users visit this Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. We use the information we get from Google Analytics only to improve this Site, but we use it only in anonymous form. Google Analytics collects only the IP address assigned to you on the date you visit this Site and assigns a user ID code, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google uses this information to analyze your use of the Site, to generate reports about Site activities for website operators and to provide further services related to use of the Site and the internet. End User Data

You also supply the data on your business or customers into our Services (“End User Data”). If you collect End User Data that identifies European Economic Area and Switzerland (“EEA”) subjects located in the EEA, you should not upload such information without notifying us and executing an appropriate Qbox Data Processing Addendum with EU Model Contractual Clauses that specifically identify the categories of data being provided. We only use this data to the extent you authorize us to through your use of the Services. Except as provided in this Privacy Policy, we do not use or share End User Data and we do not sell End User Data, except to the extent we engage in a Business Transfer of our company. When it comes to End User Data, our Customers are the data controllers and are solely responsible for determining what End User Data is collected and for what purpose it is used.

How Do We Use Your Data

If you would like information from us, we will use the information you provided to us respond to your requests.

If you choose to purchase our Services, we will use your Contact Information to set up your account and to provide the Services to you, including customer service and support.

We use Potentially Personal Data, Tracking Data, and Cookies to track trends in the use of our Site and Services, to ensure the secure use of the Services and your Content, and to customize your experience as a Customer.

We may access End User Data with Customer consent to provide support to the Customer with respect to the use of the Services.

How Do We Share Your Data

We will not sell, rent, or share Personal Data or End User Data with third parties outside of our company without your consent, except in the following ways:

Law Enforcement and Internal Operations

Personal Data may be provided where we are required to do so by law, or if we believe in good faith that it is reasonably necessary (i) to respond to claims asserted against Qbox or to comply with the legal process (for example, discovery requests, subpoenas, or warrants); (ii) to enforce or administer our policies and agreements with users; (iii) for fraud prevention, risk assessment, investigation, customer support, product development, and debugging purposes; or (iv) to protect the rights, property or safety of Qbox, its users, or members of the general public. We will use commercially reasonable efforts to notify users about law enforcement or court ordered requests for data unless otherwise prohibited by law. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to any third-party request to compel disclosure of your information.

Business Transfer

Qbox may sell, transfer, or otherwise share some or all of its assets, including your Personal Data, in connection with a merger, acquisition, reorganization, or sale of assets or in the event of bankruptcy. Under such circumstances, Qbox will use commercially reasonable efforts to notify its users if their personal information is to be disclosed or transferred and/or becomes subject to a different privacy policy.

Third Parties

We sometimes contract with other companies and individuals to perform functions or services on our behalf, such as software maintenance, data hosting, and sending email messages. We necessarily have to share your Personal Data with such third parties as may be required to perform their functions. We take steps to ensure that these parties take protecting your privacy as seriously as we do, including entering into Data Processing Addendum, EU Model Clauses, and/or ensuring they have EU-U.S. and Swiss-US Privacy Shield certification.

Your data is also stored with one of our authorized storage providers that you select from our list. We make sure we have a Processing Addendum, EU Model Clauses, and/or ensuring they have EU-U.S. and Swiss-US Privacy Shield certification.

Third-Party Service Providers

AdRoll  Qbox works with AdRoll retargeting, who uses technology including web beacons and cookies to collect data about our website usage and to improve the effectiveness of our marketing. Drift Drift is a customer sales automation tool that allows our sales representatives to interact via chatbot with potential leads that visit our site and manage inquiries from existing Customers. Drift may collect name, email address, or other Personal Data on our behalf and share it with us. Drift is self-certified under the US-EU Privacy, and their sharing of data is subject to a Data Processing Addendum. Please refer to Drift’s Privacy Policy for more information on their practices.

Google Analytics  Google Analytics collects information about the use of the Services on our website. Google Analytics collects information such as how often users visit this Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. Salesforce  Salesforce provides a set of tools for Customer Relationship Management. Salesforce is provided with customer name, address, email address, phone number, and customer needs in order to move the sales forward and maintain the relationship with the customer and potential customers. Salesforce is self-certified under the EU-U.S. and Swiss-US Privacy Shield and data transfers and protection are subject to a Data Processing Addendum and Binding Corporate Rules. Stripe  We utilize Stripe as a payment gateway for payments. Data Processing takes place in the United States, and Stripe is self-certified under the EU-U.S. and Swiss-US Privacy Shield. Users should review Stripe’s Security Policy before initiating transactions on the Site.

ZenDesk  Qbox uses ZenDesk to provide customer support, including chat for support. ZenDesk is self-certified under the EU-U.S. and Swiss-US Privacy Shield, and data transfers and protection are subject to a Data Processing Addendum and Binding Corporate Rules. How is My Data Protected?

We have implemented reasonable administrative, technical, and physical security measures to protect your personal information against unauthorized access, destruction, or alteration. For example:

  • SSL encryption (https) everywhere where we deal with personal data
  • Password protection on your account
  • Data is kept on secure, encrypted servers, located in the U.S.
  • Restricting staff access to Personal Data protected by password logs and two factor authentication
  • Regular staff privacy and security training
  • Whitelisting IP Addresses to limit access to End User Data
  • Payment Tokenization

However, because no security system can be 100% effective, we cannot completely guarantee the security of any information we store, process, or transmit.

Payments Encryption: Qbox utilizes only PCI-DSS compliant third party payment processors to ensure the security of your personal information. Users should review Stripe’s Security Policy before initiating transactions on the Site.

Your Choices

Right to Review and Rectify Your Personal Data

You can update most of your Personal Data by logging on to your account. However, if additional assistance is required to change or delete inaccuracies within your Personal Data or if you would like to know what information about you was collected, please contact us at Privacy@Qbox.io.

Right to Remove or Withdraw Consent

You have the right to withdraw consent where such consent is required to share or use data and you may request that we delete your Personal Data. If you receive communications from us and  no longer wish to receive them, please follow the removal instructions in the email or change your account settings. You can delete your Personal Data by logging into your account and deleting your account. However, since your Personal Data is required for us to provide the Services to you, deleting it will also terminate your access to the services. Deleting your Personal Data does not mean that all of it will be removed. We take steps to delete Personal Data that is no longer necessary in relation to provide the Services by deleting it within 90 days of your terminating your account or if the account remains unused for more than one year. We may be required by law to retain it to exercise or defend legal claims or contractual obligations with our customers to retain some information in connection with our obligation to provide the Services. We may de-identify and anonymize some data for purposes of retaining it.

Data Portability

If we collect data regarding persons in the European Economic Area that is required by law to be eligible for data portability and you would like us to transmit your Personal Data to another company providing similar services, we will work with them to do so upon request and verification of such request with both the requestor and the company receiving the Personal Data.  

Data Retention

We take steps to delete Personal Data that is no longer necessary in relation to provide the Services. We delete End User data within one year of customer terminating their account. We may be required by law, to retain data to exercise or defend legal claims, or to comply with contractual obligations with our customers to retain some information in connection with our obligation to provide the Services.  

Processing End User Data for Customers

Our Services may involve the processing of Personal Data on behalf of our customers.  When we do so, we are acting as processors for the controllers of such data. As such, we take steps to ensure that Personal Data subject to GDPR is processed in accordance with controller instructions and GDPR such as entering into a Data Processing Addendum incorporating EU Standard Contractual Clauses governing the processing, transmission and use of such End User Personal Data.  If you wish to exercise your data subject rights to review, rectify, delete or port your End User Personal Data please contact the controller to make such request. If you make the request to us, we will work with the controller to process and evaluate such request to confirm whether deletion is required by GDPR.

Transnational Transfer of Data

If you are providing your Personal Data to us directly to use our Services, we will transmit your data, including your Personal Data, to the United States in order to fulfill our contractual obligations to you.

Your California Privacy Rights

California residents who have an established business relationship with Qbox may make a written request to Qbox about whether Qbox has disclosed any Personal Information to any third parties for the third parties’ direct marketing purposes during the prior calendar year.  To make such a request, please send an email or write us:

Minors Under 16 Years of Age

Qbox does not knowingly collect or store any personal information from or about children under the age of 16.

If you believe a child under the age of 16 has under any circumstances provided us with personal information and data, the child’s parent or legal guardian can email us at Privacy@Qbox.io to request that their children’s information be deleted from our records.

Do Not Track

“Do Not Track” or DNT is a feature enabled on some browsers that sends a signal to request that a web application disable its tracking or cross-site user tracking. At present, our Site does not respond to or alter its practices when a DNT signal is received.

Changes to Privacy Policy

Qbox reserves the right to amend this Privacy Policy at any time. If Qbox makes material changes to its Privacy Policy, we will notify you by changing the Effective Date on our Privacy Policy and provide additional notification either via email or other means as we may deem commercially reasonable.
